1. Acceptance of Terms

These Terms of Service (“Terms”) form a binding agreement between Creative Design and Build Inc. (“we”, “us”, “our”) and the person or entity (“you”, “Customer”) who accesses our website, requests an estimate or consultation, communicates with us, or engages us for construction, remodeling, design, or related services (collectively, the “Services”).

By using our website, submitting a form, requesting Services, signing an agreement, or otherwise engaging with us, you accept these Terms and our Privacy Policy. If you do not agree, do not use our website or Services.

2. Eligibility & Customer Information

You must be at least 18 years old and have legal authority to enter into contracts on behalf of yourself or the entity you represent.

You agree to provide accurate information, including your name, contact information, property address, and relevant project details, and to keep that information current.

You are responsible for ensuring that you have the authority to authorize work at the property associated with your project.

3. Our Services

Creative Design and Build Inc. provides construction, remodeling, renovation, design, project management, and related home improvement services.

The specific scope, price, materials, schedule, and other requirements for a project will be described in a separate estimate, proposal, contract, change order, or other written agreement.

Information on our website is provided for general informational purposes and does not constitute a binding estimate, contract, or guarantee of pricing or availability.

4. Estimates, Contracts & Payments

Estimates. Estimates and preliminary pricing are based on information available at the time they are prepared. Pricing may change based on final selections, site conditions, permit requirements, material costs, labor requirements, or changes to the scope of work.

Contracts. Construction work will be governed by the applicable written agreement between you and Creative Design and Build Inc. If a project agreement conflicts with these Terms, the project agreement will control with respect to that project.

Payments. Deposits, progress payments, final payments, and other payment requirements will be stated in your applicable contract or invoice.

Additional work. Work outside the original scope may require a written change order and additional payment.

Taxes and fees. Applicable taxes, government fees, permit costs, or third-party charges may be passed through to the Customer where permitted and as described in the applicable agreement.

5. Project Information & Customer Materials

You retain ownership of information, documents, photographs, plans, specifications, and other materials you provide to us (“Customer Materials”).

You grant Creative Design and Build Inc. permission to use Customer Materials as reasonably necessary to evaluate, plan, coordinate, and perform your project.

You are responsible for ensuring that you have the right to provide and authorize our use of any plans, photographs, designs, documents, or other materials you submit.

6. Project Scheduling, Delays & Unforeseen Conditions

Project schedules and completion dates are estimates unless expressly guaranteed in writing.

Construction projects may be affected by circumstances outside our reasonable control, including weather, permit delays, inspections, material shortages, supply-chain interruptions, subcontractor availability, utility interruptions, government actions, and unforeseen property conditions.

Existing or concealed conditions such as water damage, structural issues, electrical problems, plumbing problems, mold, asbestos, pest damage, or code violations may require additional work.

If unforeseen conditions or Customer-requested changes affect the scope of work, pricing or scheduling may be adjusted through a change order or other written authorization.

7. Website Tracking, Cookies & Analytics

What we collect. When you use our website, we may automatically collect technical information including IP address, browser type, operating system, device information, pages viewed, referring URLs, timestamps, and interactions with the website.

Cookies and similar technologies. We may use cookies, local storage, analytics tools, and similar technologies to operate our website, remember preferences, measure website performance, prevent abuse, and understand how visitors use our website.

8. Privacy & California Rights

We will not discriminate against you for exercising applicable privacy rights.

Authorized agents may submit certain requests on behalf of California residents, subject to verification.

Our website and Services are not directed to children under 16, and we do not knowingly collect personal information from children under 16.

You may opt out of promotional emails using the unsubscribe link provided in those messages. You may opt out of marketing text messages by following the instructions included in the message.

Consent to receive marketing communications is not a condition of purchasing our Services.

11. Third-Party Services

We may use or integrate with third-party services including payment processors, financing providers, scheduling platforms, communication providers, analytics services, mapping services, suppliers, subcontractors, architects, engineers, and other professionals.

Your use of certain third-party services may be governed by their own terms and privacy policies.

We are not responsible for the independent actions, availability, security, or privacy practices of third-party providers except to the extent responsibility cannot legally be excluded.

EXCEPT AS EXPRESSLY PROVIDED IN A SIGNED PROJECT AGREEMENT OR REQUIRED BY LAW, OUR WEBSITE AND GENERAL INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

PHOTOGRAPHS, PROJECT EXAMPLES, ESTIMATED COSTS, DESIGN IDEAS, TIMELINES, AND OTHER WEBSITE CONTENT ARE PROVIDED FOR GENERAL INFORMATION AND DO NOT GUARANTEE IDENTICAL RESULTS FOR YOUR PROJECT.

TO THE FULLEST EXTENT PERMITTED BY LAW, CREATIVE DESIGN AND BUILD INC. WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING SOLELY FROM YOUR USE OF OUR WEBSITE.

LIABILITY RELATING TO CONSTRUCTION OR OTHER PROFESSIONAL SERVICES WILL BE GOVERNED BY THE APPLICABLE PROJECT AGREEMENT AND APPLICABLE LAW.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS OR LIABILITY LIMITATIONS. THESE LIMITATIONS APPLY ONLY TO THE FULLEST EXTENT PERMITTED BY LAW.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Creative Design and Build Inc. and its officers, employees, and agents harmless from third-party claims, damages, liabilities, costs, and expenses arising from:

(a) your unlawful use of our website;

(b) materials or information you provide without authorization;

(c) your violation of these Terms; or

(d) your infringement of another person’s rights.

This provision does not require indemnification for liability that cannot legally be transferred to you.

15. Term & Termination

These Terms remain applicable while you use our website or Services.

We may restrict or terminate access to our website if you violate these Terms, engage in fraudulent or unlawful activity, or create a security risk.

Termination of website access does not automatically cancel or modify an existing construction agreement.

Cancellation or termination of an active construction project will be governed by the applicable signed agreement and applicable law.

Sections that by their nature should survive termination will continue to apply.

16. Dispute Resolution

Disputes relating to a construction project will be governed by the dispute-resolution provisions contained in the applicable signed contract.

If no separate agreement governs the dispute, the parties agree to first attempt in good faith to resolve the matter informally.

Either party may pursue any remedy available under applicable law, including eligible claims in small-claims court.

Nothing in these Terms waives any consumer right or legal remedy that cannot lawfully be waived.

17. Governing Law & Notices

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

Notices to Creative Design and Build Inc. may be sent using the contact information listed on our website.

Notices to you may be sent to the email address, telephone number, or mailing address you provide to us.

18. Changes to These Terms

We may update these Terms from time to time.

Material changes will be reflected by updating the “Last updated” date shown above and, where appropriate, providing additional notice.

Non-material changes may take effect immediately upon posting.

Your continued use of our website following the effective date of updated Terms constitutes acceptance of those changes.

Updates to these website Terms do not modify an existing signed construction agreement unless agreed upon as required by law.

19. Miscellaneous

These Terms, together with our Privacy Policy and any applicable estimate, proposal, contract, change order, or other written agreement, constitute the applicable agreement between the parties regarding the subject matter they cover.

If any provision is held invalid or unenforceable, the remaining provisions will continue in effect.

Our failure to enforce any right or provision does not constitute a waiver.

You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations in connection with a merger, acquisition, reorganization, or sale of substantially all relevant business assets.

Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency relationship between you and Creative Design and Build Inc.
